Spouse / Civil Partner Visa
The meaning of 'present and settled' is to be in possession of indefinite leave to remain (ILR) or the right of abode, combined with physical presence in the UK.
If your partner is not "present and settled" proceed to question 2, otherwise you will meet the criteria for this category.
