Ask a UK Immigration Lawyer About ILR for Victims of Domestic Violence

If you are in the United Kingdom on the basis of your marriage/relationship to a British citizen or person present and settled here and your relationship breaks down as a result of domestic violence, you can apply for Indefinite Leave to Remain under this category.

You must meet the following criteria:

  • Your relationship with your spouse, civil partner, unmarried partner or same-sex partner, as appropriate, was subsisting at the time you were granted Leave to Remain;

  • You are able to produce such evidence as may be required by the Secretary of State to establish that the relationship was caused to permanently break down before the end of that period as a result of domestic violence.

If your application is successful, you will be granted Indefinite Leave to Remain.
